Terms of Service

Welcome to Spotzy! These Terms of Service (“Terms”) govern your access to and use of the Spotzy platform, including our website and services (collectively, the “Service”). By using Spotzy, you agree to these Terms. If you do not agree, please do not use the Service. These Terms are governed by Estonian law. 1. The Spotzy Service

1.1 Overview: Spotzy connects people with extra storage, parking spots or work spaces (“Hosts”) to those seeking such spaces (“Renters”). Spotzy acts solely as a facilitator and does not own, manage, or control the listed spaces.

1.2 Modification of Terms: We may update these Terms from time to time. Changes will be effective upon posting. Continued use of the Service constitutes acceptance of the updated Terms.

2. Definitions

Host: An individual or entity offering storage or parking spaces for rent via Spotzy.
Renter: An individual or entity renting a space listed on Spotzy.
Space: The property or portion thereof listed by the Host, such as garages, storage units, driveways, office rooms, workshops.
Service Fees: Fees charged by Spotzy for facilitating the transaction.
Platform: Spotzy’s website, mobile application, and related services.

3. Eligibility

3.1 Account Registration: You must create an account and provide accurate and complete information. You are responsible for keeping your login credentials secure and for all activity under your account.

3.2 Age Restriction: You must be at least 18 years old to use the Spotzy platform.

4. User Responsibilities

4.1 Prohibited Activities: You agree not to:

Use the Service for illegal purposes.
Post or share inaccurate, harmful, or defamatory content.
Violate intellectual property, privacy, or other rights of others.
Damage, misuse, or endanger the spaces rented or listed.

4.2 Compliance with Laws: Users are responsible for ensuring their activities comply with applicable local, state, and national laws.

5. For Hosts

5.1 Listing a Space: Hosts can list their spaces by providing accurate details, including size, location, availability, price, and rules. Hosts are responsible for ensuring their spaces comply with all local laws and safety standards.

5.2 Earnings and Fees: Spotzy deducts a service fee from each booking. Payouts are processed securely and are subject to processing timelines. Hosts are responsible for declaring and paying taxes related to their earnings. According to the Estonian Tax and Customs Board Act, Hosts are responsible for declaring and paying income tax on rental income earned through the Spotzy platform.

5.3 Host Responsibilities:

Hosts must maintain the safety, cleanliness, and legality of their listed spaces.
Hosts must honor confirmed bookings and provide the agreed-upon access.
Hosts agree to indemnify and hold Spotzy harmless from any claims arising from their listing or misuse of the Space.

5.4 Prohibited Listings: Spaces that are unsafe, unsuitable, or violate local laws may not be listed. Spotzy reserves the right to remove such listings.

6. For Renters

6.1 Booking a Space: Renters can search for and book spaces listed on Spotzy. Payment must be made through the platform at the time of booking. If the Host has chosen manual booking approval, the Renter must wait until the Host accepts the booking. If the Host has not enabled manual approval, the Renter will automatically receive a booking confirmation email once payment has been completed.

6.2 Use of Spaces: Renters must use spaces as described in the listing and comply with the Host’s rules. Renters are responsible for any damages caused during their use.

6.3 Prohibited Activities: Renters may not store illegal items, hazardous materials, or conduct illegal activities in the rented space.

6.4 Cancellation Policy: Cancellations are governed by the Host’s policy outlined in the listing. Refunds, if applicable, will follow the Host’s terms. If you are a consumer, you may also have a statutory right of withdrawal under applicable law. Hosts are required to clearly specify their cancellation policy in the listing, and by booking you agree to those terms. 7. Payments

7.1 Secure Payments: Payments are processed through Spotzy’s third-party payment provider. Spotzy does not store sensitive payment details. Prices are clearly displayed before the payment process begins, showing both the rental price set by the Host and the Spotzy service fee used to maintain the platform.

7.2 Refunds: Refunds, if applicable, will be processed according to the Host’s cancellation policy or as determined by Spotzy in disputes. Consumers may have a statutory right of withdrawal under Estonian law. This right allows a consumer to withdraw from the booking within 14 days, unless an exception applies (for example, if the service has already been fully provided or the Host’s cancellation policy specifies otherwise). To exercise this right, consumers must submit a withdrawal notice in writing. Spotzy will process any applicable refunds in accordance with legal requirements and the Host’s cancellation policy.

7.3 Payment Methods: Payments on the Spotzy platform can be made securely using the following methods:

Credit and debit cards (Visa, Mastercard) processed through EveryPay (LHV Paytech).
Apple Pay and Google Pay, available when linked to supported cards.
Bank link payments (pangalingid) from supported banks in Estonia (LHV, Swedbank, SEB, Luminor, Coop, Citadele), Latvia (Swedbank, SEB, Luminor, Citadele), Lithuania (Swedbank, SEB, Luminor, Šiaulių bankas, Citadele), as well as Revolut.

Spotzy does not store card details; all payment data is processed securely by our payment service provider.

8. Prohibited Items

The following items and substances are strictly prohibited from being stored using the Spotzy platform:

Stolen vehicles (including bicycles) or any other stolen property.
Illegal items, including drugs and drug paraphernalia.
Any living things, including animals, insects, fungi, or bacteria.
Items that emit strong odors, gases, leak liquids, or are damp.
Dangerous, contaminated, chemical, flammable, radioactive, or toxic materials.

9. Liability and Disclaimers

9.1 Platform as an Intermediary: Spotzy provides a platform for connecting Hosts and Renters and does not assume liability for the condition of the Space or disputes arising between Hosts and Renters.

9.2 Limitations: Spotzy is not responsible for the loss, theft, or damage of items stored or vehicles parked in the Space.

9.3 Force Majeure: Spotzy shall not be liable for failure to perform due to circumstances beyond its control (e.g., natural disasters, government actions).

10. Dispute Resolution

10.1 Between Users: Spotzy encourages Renters and Hosts to resolve disputes amicably. If a resolution cannot be reached, Spotzy may mediate but is not obligated to do so. Consumers have the right to file complaints within 14 days after the service. Complaints can be submitted by email to help@spotzy.eu. Spotzy aims to respond to all complaints within 5 working days.

10.2 Legal Proceedings: If a resolution cannot be reached, disputes will be resolved under the jurisdiction of Estonian courts.

11. Intellectual Property

11.1 Ownership: All content on the Spotzy platform, including logos, text, and graphics, is the property of Spotzy and protected by intellectual property laws.

11.2 User-Generated Content: By posting content on Spotzy, you grant Spotzy a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content for platform-related purposes.

12. Termination

12.1 By Spotzy: Spotzy may suspend or terminate your account at any time for violations of these Terms or for any other reason at its sole discretion.

12.2 By User: You may delete your account at any time by yourself or contacting Spotzy support. Any outstanding obligations must still be fulfilled.

13. Indemnification

You agree to indemnify and hold Spotzy, its affiliates, and employees harmless from any claims, losses, or damages arising out of your use of the Service, your breach of these Terms, or your violation of any rights of a third party.

14. Miscellaneous

14.1 Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Spotzy regarding your use of the Service.

14.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

14.3 Force Majeure: Spotzy is not responsible for delays or failures caused by events beyond its reasonable control, such as natural disasters or internet outages.
